Review of the sentence for loss of driving license points

Road safety

A person was convicted because allegedly driving a car when he had already lost all his points from his license, which is a crime. However, after the sentence, the defense obtained new evidence that completely changed the story, as it turned out that the points withdrawal had been an administrative error. Why? Because the accused's data (his ID number) matched the NIE of another person who had committed offenses, and it was the wrong person who had the points withdrawn.

The body responsible for managing fines and penalties acknowledged the sentence and returned the points unfairly withdrawn. When these documents were submitted, the Public Prosecutor's Office agreed that the case needed to be reviewed, because the innocence of the convicted person was proven with new and clear facts, as allowed by the law.

In the end, the Supreme Court (TS) acknowledges that the review appeal is an exceptional matter, but in this case the injustice was clear. Thanks to the new documentation, it is shown that the accused had all the points on his license in order on the day of the events and should never have been convicted. Therefore, the Supreme Court annulled the sentence and declared the accused innocent. This highlights the importance of properly reviewing traffic penalties and appealing if there are indications of administrative errors.
